Registration fees

The party who first files a case, after login, need pay a sum of Rs.2000/- against Registration.

Outside India and Indian Subcontinent the Registration Fee is 50 USD.

The online platform MEDIATOR AFFAIR would make the way for the party to have an access to justice. With the case getting filed, the opposite party would get contacted and invited to involve in the stream of Resolution.

The registration fees will cover entire online dispute resolution processes such as

• Online General Mediation

Administrative Fees

The online platform MEDIATOR AFFAIR facilitates the parties with an opportunity to enjoy the long sessions of resolution process @. reasonable administrative fees.

The administrative fess will cover entire online dispute resolution processes such as

• Online Arbitration
• Online Business Mediation
• Online General Mediation

The administrative charges also include rent against using the software enabling the procedure so as to facilitate the dispute resolution process.

Online Arbitration

It is as simple as that. A day may have different sessions. A case may take a few sessions in a day or say a full day or more than one day to get resolved. In India and Indian sub-continent total administrative fees against one full day consisting of different sessions will cost only Rs.6000/ - from initiating party as well as the party who counter claims against the claim originally submitted.

In overseas countries total administrative fees against one full day consisting of different sessions will cost only USD 120 from - from initiating party as well as the party who counter claims against the claim originally submitted.

Online Business Mediation

It is as simple as that. A day may have different sessions. A case may take a few sessions in a day or say a full day or more than one day to get resolved. In India and Indian sub-continent total administrative fees against one full day consisting of different sessions will cost only Rs.5000/ - from single or both parties. (from petitioner and respondent in case he has special interest over the decision resulting out of the settlement)

In overseas countries total administrative fees against one full day consisting of different sessions will cost only USD 100 from single or both parties (from petitioner and respondent in case the latter has special interest over the decision resulting out of the settlement)

Online General Mediation

The terms in respect of online business mediation is applicable in this case too.

In India and Indian sub-continent total administrative fees against one full day consisting of different sessions will cost only Rs.4000/ - from single or both parties (from petitioner and respondent in case he has special interest over the decision resulting out of the settlement).

In overseas countries total administrative fees against one full day consisting of different sessions will cost only USD 80 from single or both parties (from petitioner and respondent in case he has special interest over the decision resulting out of the settlement)

Professional Fees

• Prior to Arbitration, the parties/clients have to go through the price tariff and rules and regulations provided by the ODR providers and hence they can have a discussion with the arbitrator to this effect and get clarifications from Case Administrator
• For online mediation (online business mediation and general online mediation), the pre-mediation calls may help the parties to reach terms with the pricing details like the fee structure of Mediating Forums or Mediator as the selected mediator will assess the sessions and days to complete the case filed, and he will disclose the price tariff on the base of his assessment. Further a mediator shall be required to maintain a detailed and accurate record of the work done and the time spent on the mediation hence he will declare the excess fees before the declaration of the decision. As such the proforma invoices will be raised against such events.
  Following the termination of the mediation, a copy of such records shall be provided to the parties and the Center (Samzin ODR Center) together with the mediator's invoice against which fees are already effected.

CANCELLATION/CONTINUANCE POLICY

• For hearings of 1 day or less cancelled/continued 30 days or more prior to the hearing date: Fees are 100% REFUNDABLE except for any arbitrator/mediator time incurred
• For hearings of 2 days or more cancelled/continued 60 days or more prior to the hearing date: Fees are 100% REFUNDABLE except for any arbitrator/mediator time incurred
• For hearings of any length cancelled or continued inside the cancellation/continuance period: Fees are NON-REFUNDABLE

In online arbitration the fees (administrative as well as professional fees) are due within 72 hours of the respondents accepting the invitation to file the counterclaim on the part of the claimant and 24 hours in respect of the respondent or filing the counterclaim whichever is earlier.

In online mediation (online business mediation and online general mediation) the fees (administrative as well as professional fees) are immediately due at the time of the respondents accept the invitation

The receipts against each payment will be digitally printed and issued to the respective parties.

Receipt of payment for all fees is required prior to delivery of an arbitration and mediation award (to be scanned and uploaded after the post-hearing session).

Samzin Smart Strategies Pvt. Ltd (SSS) reserves the right to cancel a hearing if fees are not paid by all parties by the applicable cancellation date and SSS confirms the cancellation in writing

REFUND POLICY

Administrative Fees as well as Professional Fees are non-refundable as it is paid on getting convinced over the fact that the opposite party is willing to participate in the negotiation/mediation/arbitration process. Unless such event occurs, there is no need to pay the aforementioned fees. Hence there is no question raises to the effect of cancellation so far the petitioners and respondents are there to participate in the online dispute resolution processes
